A bareboat charter is a form of chartering in which a vessel is hired by a charterer for a specified period without the crew, officers, fuel, stores, and day-to-day operational services normally supplied by the shipowner. It is also known as a “demise charter” because the charterer effectively takes possession and control of the vessel for the agreed charter period. Under this arrangement, the shipowner provides the vessel in a seaworthy condition, while the charterer assumes responsibility for its operation, crewing, maintenance, insurance, fuel, navigation, and other operating expenses. In international trade, a bareboat charter is important because it provides exporters, importers, shipping companies, and other commercial operators with access to vessel capacity without requiring them to purchase the vessel outright. The basic feature of a bareboat charter is the transfer of operational possession of the vessel from the owner to the charterer. The charterer has extensive control over the ship during the charter period and generally appoints the master and crew. The charterer also decides how and where the vessel will be employed, subject to the restrictions contained in the charter agreement and applicable maritime laws. This distinguishes a bareboat charter from other forms of chartering, such as a voyage charter or time charter, where the shipowner generally retains greater control over the vessel and provides the crew and operational services. A bareboat charter normally begins with a formal charter party agreement. The charter party specifies the rights and obligations of both parties and contains important commercial and operational conditions. It generally identifies the vessel, charter period, delivery location, redelivery conditions, permitted trading areas, hire payable, payment arrangements, insurance responsibilities, maintenance obligations,
